Welcome to InfoHarborPlatform ("we," "our," or "us"). These Terms & Conditions ("Terms") are applicable to your use of our services, including the yacht charter services offered through our website situated at infoharborplatform.sbs ("Service"), provided by InfoHarborPlatform.
Engaging with our Service or booking a charter signifies your agreement to comply with these Terms. Should you not concur with any section of these terms, you are not authorized to use our Service.
2. Service Overview
InfoHarborPlatform specializes in upscale yacht charter solutions, featuring options like:
- Exclusive yacht rentals for the day
- Scenic evening cruises
- Deluxe corporate getaways
- Customized private parties
- Extended yacht charters
We offer services based on availability and prevailing weather conditions. We retain the authority to alter or withdraw services as necessary.
3. Booking and Reservations
3.1 Booking Process
Charter reservations are subject to the following requisites:
- A minimum age requirement of 18 years
- Submission of correct and comprehensive details
- Payment of the deposit as outlined in your reservation confirmation
- Acquiescence to these Terms & Conditions
3.2 Confirmation
We consider your booking as confirmed once the payment has been processed and we provide written confirmation. Service may be denied at our sole discretion.
3.3 Availability
Charter availability relies upon both vessel availability and appropriate weather circumstances. We strive to accommodate your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All of our charges are stated in € and tax-inclusive unless stated otherwise. We reserve the right to adjust prices without notice.
4.2 Payment Schedule
- Initial Deposit: 50% of the total charter fee payable at the time of booking
- Final Balance: Due 48 hours preceding the charter departure
- Additional fees (if any): Payable at the completion of the charter
4.3 Payment Methods
We process payments through secure means, including major credit cards, bank wires, and bank drafts.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancellation occurs over 72 hours before departure: A full refund except for processing costs
- If cancellation occurs between 24 to 72 hours before departure: A refund of 50%
- If cancellation occurs less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
In case the captain deems the weather unsafe, we will propose to either:
- Reschedule to another available date with no extra charge
- Offer a complete refund when rescheduling isn't an option
5.3 Mechanical Issues
In the occurrence of technical issues with the assigned vessel, we will endeavor to offer a suitable alternative. If this is not attainable, a complete refund will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All persons on board are required to:
- Adhere to instructions given by the crew
- Utilize safety gear as necessary
- Disclose any health conditions that could affect their safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
Passengers must refrain from bringing the following aboard:
- Glassware
- Illegal substances
- Weapons of any sort
- Pets, unless they have prior approval
6.3 Conduct
Passengers are expected to behave respectfully. Any disruptive or dangerous behavior may result in the immediate termination of the charter without a refund.
7. Liability and Insurance
7.1 Our Liability
Our financial responsibility is confined to the payment you have made for your charter. We are not accountable for:
- Injuries inflicted by passenger neglect
- Damage or loss of personal belongings
- Incidental, consequential, or punitive damages
- Delays caused by weather or other unforeseen events
7.2 Insurance Coverage
We maintain a comprehensive marine insurance policy covering our vessels and operations. However, passengers are liable for securing personal and travel insurance.
7.3 Assumption of Risk
You acknowledge that marine activities come with inherent threats by choosing to participate in our services, taking accountability for your safety.
8. Modifications and Itinerary Changes
At our discretion, itineraries, paths, or schedules may be adjusted in the interest of safety or due to operational considerations. We will make best efforts to offer equivalent alternative experiences when changes occur.
9. Force Majeure
We shall not be held liable for interruptions, amendments, or cancellations brought on by forces beyond our control, including, but not restricted to:
- Extreme weather events
- Natural catastrophes
- Governmental decrees
- Port constraints
- Unforeseen mechanical breakdowns
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. By selecting our services, you consent to our data collection and usage as described in the policy.
11. Intellectual Property
All materials on our website, such as texts, graphics, trademarks, and imagery are protected by copyright. Unauthorized reproduction, distribution, or modification is prohibited without our explicit consent.
12. Governing Law
These Terms are subject to the laws of the Spain. Disputes will be resolved in the courts of Barcelona, Spain.
